When I was around 12 my mother divorced my abusive father and moved us (my younger brother, sister, and myself) into a house with one of her friends. It wasnt the best environment, meaning the house was a bit rundown and had rats but there was no drugs, no violence, and no grandparents. She enrolled us in school, made sure we had clothes, food and everything we needed. The living situation was just temporary, she got nothing out of the divorce. Well, my grandmother got it in her head that we were not being treated the right way, she convinced my mother to let her take us just for the weekend, my mother agreed and that would be the last time I ever lived with her or even got to see her for quite some time. My grandmother went straight to her lawyer, who she went to church with and knew on a social level. The lawyer took to court the fact that our living conditions were not as good as if we lived with our grandmother, she also argued that my mother was homeless and had a drug addiction, which was NOT TRUE. She drug in my fathers abusive side and argued that my mother was in no stable condition to take care of us. My mother was mailed the wrong date to show up in court thus missing the custody hearing, I believe her because Ive seen the papers she was mailed. The judge ruled in favor of my looking-like-a-saint grandmother who had 10 kids of her own and had in fact adopted my mother and her sister when they were young. The judge was also my grandmothers lawyers father. Which helped her case. Alot. They told my mother she could either sign her rights away to my grandmother or they would put all three of us in foster care. So she had no choice. Now that all happened when I was 12, I am 16 now I turn 17 in september. My grandmother, along with my aunt, have moved to Texas (we lived in Tennessee). Im miserable here. I love my grandmother very much shes my mommom and no one could take her place in my heart but, my mother is my mommy and my grandmother can never replace her. I know my grandmother had my best interest at heart but just because my mother was going through a hard time and didnt have as much money or as nice a house as her she took us. I want to live with my mother who still lives in tennessee, has her own two bedroom apartment, a steady job and income, no drug or alcohol problems and wants me to live with her badly. Ive tried talking to my grandmother about this but she just gets angry and tells me if the court finds out Im even talking to my mother theyll put me in foster care, which by the way is not true (i hope) she tried to tell me it said in the adoption papers that I couldnt have any contact with my mom but Ive read them and even told her to tell me where it said it and it does not say that. She then tried to say it said it in her will. I laughed. Then when that didnt work she tried to tell me it was in some secret court paper locked away in Nashville and she couldnt get a copy of it because it was sealed away for good. Ive stopped believeing anything she says. She lies. Alot. My younger sister and I are currently in online homeschooling (me 10th her 4th) well Ive ended up being the one doing her school work for her since the begining and I havent been able to keep my school work up because of it so im not getting an education. Ive also been admitted to a mental home for trying to kill myself and for cutting myself (i still cut) from stress caused by my grandmother and depression of losing my mom. My aunt tries to act like my mother also always calling us “her kids” we are not her kids! She is 41 and has no life, never moved out, and has never dated. My grandmother and aunt mean the world to me but Im completely miserable here and stressed to the max. I want to get my GED or finish highschool. I want to get a job and get my license. But I cant get a job because my grandmother has me on disability she has all three of us on it and I AM NOT DISABLED there is absolutely nothing wrong with me at all. Its just a way to get an easy check for her. So after reading all this (thank you!) is there any advice anyone can give? any ideas? anyone going through or has gone through the same thing? please if you can give me a number to call to talk to some legal person who could help me in tennessee or texas please do. Ok my brother lives in Tennessee. He’s on probation for a dui he got a few years ago. He saw his probation officer and paid the fines every month. His place of work moved to Kentucky so he had to go as well. My mom still drove up there every month to bring him back to take him to his probation officer. After a few months they laied him off. He didn’t have money to pay his proby officer and my mom couldn’t afford to go get him every month to take him. He stayed in Kentucky for 2 years and he finally decided to come back and turn himself in. He did so and bailed out and got a new job and turned his life around. He’s now doing great clean from drugs and alcohol and working hard. He’s even going to a treatment center every week for drugs and alcohol. When he went to court the judge gave him 30 days in jail for his first violation of probation. So he told the judge he wants a public defender. The public defender said he wont have to go to jail for that long because its his first violation of probation, he turned himself in, and he’s in treatment for drugs and alcohol. So my question is does anyone have any idea of how much time he’s looking at? Maybe someone has been in the same situation or a similar one and has an idea of what he may receive wether jail time or fines and or community service? Thanks in advance.
